*Items are sold as-is and may have defects. It is the buyer’s responsibility to examine, request additional information, etc. to ensure that the items are what is expected.
PICK UP LOCATION: Bontrager’s Auction Center, 8975 Wortendyke Road, Batavia, NY 14020. The auction pickup area at our auction center will be confirmed when you make your appointment.
Shipping only on select lots with the “Shipping Available” icon. Buyer pays shipping plus handling fees ($5 – $25, depending on size/fragility, etc.) For those having items taken to UPS for professional packaging, we charge $20 for staff time involved. We do not ship to PO Boxes, and we do not overnight express packages.
PAYMENT: All payments will automatically be charged to the buyer’s credit card. All buyers pay 13% buyers premium.
MERCHANDISE PICKUP DATE BY APPOINTMENT ONLY: Monday, October 12th, 12 noon to 6 p.m. We are required by NYS law to limit the number of people at the site, so appointments are required.
-If you are unable to pick up on the scheduled date, please send someone in your place or kindly refrain from bidding in this auction.
-Customers will be assisted by appointment times. Those who arrive hours ahead of time or “drop in” without an appointment may be asked to wait while those with appointments are assisted first.
-There is an extra charge for alternate pick up times, plus storage fees.
-Properly worn face mask is required by NYS law at the auction pickup site.
By bidding with our auction company, you are agreeing to the following.
-All sales are final. Everything is sold “AS IS” with no guarantees unless otherwise stated by the auctioneer. It is the responsibility of the bidder to assure him or herself as to the condition of items prior to bidding. Condition reports given by the staff of Bontrager’s Auction Service are subjective, and while we strive to be honest, we will not be held responsible or liable for any errors in description. Buyer is responsible for examining items before bidding. Auction company does not take responsibility for buyer’s failure to examine. Merchandise is not subject to adjustments once the item has been sold.
-Bontrager Real Estate & Auction Service and its staff will not be held responsible or liable for any errors in absentee/left bids or phone bids, nor for the possible failure to execute left bids for any reason.
-Payment is due in full within the time limits posted in the auction. For this auction, all payment will be made through the credit card you provide when you register. We accept Visa, MasterCard or Discover. (Please note that while you may be able to register for our auction with any credit card, we will only accept Visa, MasterCard, or Discover for payment.) 13% buyer’s premium and NYS sales tax added to all items purchased. Late payment will result in a $25 late fee.
-Charges will range from $10 – $25 depending when auction purchases are not picked up on the designated pick up date, even if you are consolidating pick ups for multiple auction purchases. Charges will vary depending on location (many items are not at our auction center), size, fragility, and length of storage time.
-By bidding with our auction you are entering into a contract with our terms and conditions. You are accepting responsibility to perform your duties as winning bidder, and agreeing that Bontrager Real Estate & Auction Service, its employees, officers, owners, representatives, agents, and consignors will not be held liable for any losses, claims, liabilities, judgments, expenses, fees, or other damages arising from the use of our services, website, auction property, and this site, including property damage, injuries, dispute with another bidder, or breach by bidder of this site. Any liability to a purchaser will not exceed the purchase price actually paid.
-Successful bidders will sign their receipt at the time of merchandise pick up indicating that all items are present and in satisfactory condition. No returns, refunds or exchanges will be issued after the merchandise leaves the pick up location.
-Bontrager Real Estate & Auction Service will not be held responsible for any interruption in internet service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. By bidding with our company you are accepting that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.
-Bontrager Real Estate & Auction Service has the right to void any sale, suspend bidding, re-sell any item/lots for any other reason.
-All sales are subject to appropriate sales tax and buyer’s premium. Buyer’s premium is 13% of purchase price and is subject to sales tax.
-Bids cannot be retracted once the auction begins.
-Buyers are responsible for making arrangement to pay for and pick up items within the time frames listed for the auction. Any variation, resulting in late pick up or payment will result in additional fees of $10 – $25, plus additional fees required for moving or storing the merchandise. There is no delivery service for this auction. Bontrager’s Auction Service is not liable for any damage to property left on the auction premises after the auction, whether or not payment has been made. We reserve the right to impose a storage fee of $10 per month for property not picked up within stated deadlines. Merchandise left 1 month after the auction is subject to sale with the proceeds covering storage and auction fees due to the auction company.
-Buyer pays shipping fees, handling charges (usually $10 – 25 depending on the size/weight/bulk of the package. The auction company will take fragile items to UPS for professional packaging (there is a $10 handling fee for this service.) Buyer pays duty and taxes for shipping outside the USA.
-In the event of legal proceedings arising from this contract or from the auction in connection therewith, buyer consents to being subject to the personal jurisdiction of the courts of the State of New York, Genesee County.
-For this auction, payment is by credit card only. There is one day only merchandise removal at the location listed.
